What is an EA?

An Enrolled Agent (EA) is a federally-authorized tax practitioner with technical expertise in taxation, empowered by the U.S. Department of the Treasury. EAs can represent taxpayers before the Internal Revenue Service (IRS) at all administrative levels, including audits, collections, and appeals.

EAs must adhere to the Department of Treasury’s Circular 230 regulations, governing their practice before the IRS. Additionally, NAEA members follow a Code of Ethics and Rules of Professional Conduct.

What does the term “Enrolled Agent” mean?

“Enrolled”: Licensed to practice by the federal government.

“Agent”: Authorized to represent taxpayers before the IRS.

Only Enrolled Agents, attorneys, and Certified Public Accountants (CPAs) can represent taxpayers before the IRS. The Enrolled Agent profession began in 1884 to regulate those representing citizens in dealings with the U.S. Treasury after issues with Civil War claims.

How does one become an Enrolled Agent?

To become an EA, one must either:

  • Pass a comprehensive examination covering all aspects of the tax code.
  • Have five years of experience working at the IRS in a role interpreting and applying the tax code.

All candidates undergo a rigorous background check by the IRS.

How can an Enrolled Agent help me?

Enrolled Agents can:

  • Represent taxpayers audited by the IRS, leveraging their specialized tax knowledge.
  • Advise and represent taxpayers.

Prepare tax returns for individuals, partnerships, corporations, estates, trusts, and other entities with tax-reporting requirements.

Privilege and the Enrolled Agent

The IRS Restructuring and Reform Act of 1998 grants federally authorized practitioners limited client privilege. This privilege ensures confidentiality between the taxpayer and the EA in cases involving audits and collections, but not for tax return preparation or state tax matters. Some states have an accountant-client privilege.

What are the differences between Enrolled Agents and other tax professionals?

  • Competence: EAs must demonstrate their tax expertise to the IRS.
  • Specialization: All EAs specialize in taxation, unlike attorneys and CPAs who may not.
  • Licensing: EAs are licensed by the federal government, while CPAs and attorneys are state-licensed.

Are Enrolled Agents required to take continuing professional education?

Yes, EAs must complete 72 hours of continuing professional education every three years, as required by the IRS. Members of the National Association of Enrolled Agents (NAEA) must complete 90 hours in the same period. With stringent requirements to become and remain an EA, there are approximately 46,000 practicing Enrolled Agents.
